Decrees must recognize the Covid-19 as an occupational disease in the days to come

The secretary of State Laurent Pietraszewski, in charge of the protection of the health of employees against the epidemic of Covid-19 from the minister of Labour, said Tuesday at the Meeting that "orders" would be submitted "in the coming days" on the recognition of the Covid-19 occupational disease.

Mr. Pietraszewski recalled that the recognition of occupational disease for the caregivers, as promised by the minister of Health, Olivier Véran, was "a duty" to these professions. He was responding to a question from the member (Generation.s) of the Loire Régis Juanico on the recognition of occupational disease for the trades other than staff, cashiers, firefighters, postal workers, maintenance workers...). "For other workers that you mention, that might have been contaminated in the framework of their professional activity, we will also make sure that they can get compensation under the occupational disease", he said. "I do not agree with your proposal to create a fund, I believe that it is logical to register this in the system of occupational disease which is already proven, works well and seems to me quite appropriate", he added. "We will present in the coming days to the decrees which will then be published very quickly on the subject," he added.

The secretary general of the CFDT, Laurent Berger, had deemed last week "unbearable" to be still not fixed clearly on the recognition as an occupational disease of the coronavirus. The CFDT wants the recognition of the Covid-19 as an occupational disease for all the trades, and other trade union organisations, and not only for the caregivers.

A list of recognized occupational diseases is established in the tables annexed to the social security Code and rural code. If the employee falls within the criteria (with durations of exposure to the risk, it does not need to prove the connection between his pathology and his work. If all criteria are not met, there must be proof of the link between his work and the disease, and it is so much more complicated. Moreover, out of these tables, any employee believed to have contracted a disease as a result of work can make a folder from a regional committee for the recognition of occupational diseases. The process is very long, "an obstacle course", according to several union sources.

How to prove that the disease was caught at his place of work ? For caregivers, I would, but in the other trades ? We know very well that all the world has not respected the containment to the letter. And not just along the Saint Martin canal...everywhere in France, small sprains, arrangements, aperitifs entrance neighbors or friends...
