The full Council of the General Council of the Judicial Power (CGPJ) has agreed on Thursday to eject from the judicial career of the policeman Magistrate Manuel Arce for a very serious lack consisting of the dissenting or rejected delay in the processing of multiple judicial processes. Fourteen vowels have voted in favor of expulsion and seven against, according to legal sources to the world.
It has been against its definitive separation of the vowels Nuria Díaz Abad, Concepción Sáez, Rafael Mozo, Enrique Lucas, Roser Bach, Vicente Guillare and Victoria belt.
The Government Body of the Judges has thus estimated the proposal of the promoter of disciplinary action, Ricardo Conde, who had urged that the magistrate was definitely separated from jurisdictional function. The CGPJ has considered arcinally responsible for a very serious infringement of Article 417.9 of the aforementioned Organic Law of the Judicial Power.
Two voting have been carried out at the meeting of this Thursday, organ sources report. In the first one, all unanimously advisors have pointed out that it is a conduct framed as very serious lack in organic law.
However, in the second vote, the fracture of the plenum has occurred because a group of vowels have defended that the expulsion of the race was a disproportionate measure with respect to the lack committed, that is, the delay in the processing of matters. Meanwhile, a majority of 14 vowels has understood that Maple has been sanctioned up to fifteen occasions and that, with those disciplinary background, there was no other action than his career expulsion.
The truth is that Arce had already been sanctioned by advice a fortnight of times throughout his professional life. The last time it was in July 2020 when a sanction of functions was imposed for three years by another very serious lack of overlooking the functions of it in the Court of First Instance number 5 of Tarragona.
In this disciplinary file, it consisted of the low yield of the aforementioned Judge who, within a period of seven months, put an average of three sentences per month and suspended 28 oral views. He did, in addition, as he was processed by the Council his previous disciplinary file for the same reason.
Most vowels from full, in a hot debate maintained on Thursday at the headquarters of the Judicial Power, has opted for maple expulsion, considering that their attitude reflects a clear length in the performance of jurisdictional function. It is the first that this Council agrees to the separation of a career judge for a disciplinary lack.
