According to EFE Sources of the Prosecutor's Office, the Fiscal Ministry considers, furthermore, that all those diligences that Judge Instructor believes needed for the investigation of the facts in relation to the cause, whose reopening decreed on September 2 Magistrate Juan Manuel Hermo Costa, at the request of the parents of the child, represented by lawyer Marcos García-Montes.

García-Montes assumed in 2019 the representation of the case and in July 2020 announced that he was going to request the reopening of the investigation against Antonio Ojeda, the Rubio, the last suspect, and the abstention of the judge who dismissed the case, considering that it was "Partial" in its resolution.
