The provincial audience of Madrid has given the open procedure folder against the president of the Sociological Research Center (CIS), José Félix Tezanos, by alleged embezzlement of public flows, as it consists of a car who has had access to the world.
In the resolution, the Court estimates appeal appeal brought by the State's advocacy, to which the Prosecutor's Office was addressed, against the decision of the Holder of the Court of Instruction number 29 of Madrid who admitted last August a complaint Interposed by VOX and cited as accurate to Tezanos on October 29th.
In the car, Section 16 of the Audience of Madrid annuls the auto opening the cause, leaving it expressly without effect, "the inadmission of the complaint and the consequent provisional dismissal of the actions" should be agreed upon.
"It is evident that an erroneous interpretation of the sense of voting in certain surveys does not justify the beginning of a criminal investigation, especially when it is neither tested to see what criminal reproach could deserve such behavior and that certainly nothing has to do with the crime of Embepping of public flows to which the challenged resolution alludes, "says magistrates when ordering the case file.
In addition, the room reproaches VOX that its pretension with the exercise of criminal action is to "analyze the bankruptcy of trust of the citizen regarding the form of using public flows, although at the same time does not explain what the typical behavior in that supposedly the complaint would have been incurred, this being precisely the only task of the courts of the jurisdictional order where we find ourselves, then the tasks of control over public bodies should be derived, although inappropriately might want to be required, this way, to the corresponding administrative channels ".
In the complaint filed by the training led by Santiago Abascal, it was argued that the functioning of the CIS since Tezanos was appointed president in 2018 is "irregular". Vox accused him, among other things, to manipulate the way of doing the surveys to benefit the PSOE.
La Complain was sustained in an expert report provided by VOX that, in the Court's opinion, "does not constitute but a mere compendium of opinion articles on the constant errors in which published surveys, whose conclusions have nothing to do with the imputation of illicit criminal ".
However, court reproaches are not aimed at VOX only but also to the Instructor María Cristina Díaz. "Certainly the resource has to receive a favorable reception and resolution left without effect, since it is the attention that the instructor, maybe due to the vague and imprecise terms that sustain the complaint and the expert report that accompanies it, does not require in the Auto challenged which are the concrete facts to investigate or, above all, explain what relationship the behaviors described with the crime of embezzlement of public flows that are supposedly referred, and such a lack of concretion attributable to the popular accusation in the exercise of the Criminal action should only behave, without the need to enter into other considerations on the prospective nature of the intended research, the inadmission as a process of the complaint, "recalcan the magistrates of the audience.
Now, after the decision of the Hierarchical Superior, Judge has left no other option to archive the procedure open to the President of the CIS because against this decision of the Chamber there is no appeal.
