The Constitutional Court (TC) considers that the closure of Parliament during the first confinement violated the rights of deputies to exercise their legislative and control task.
This is considering a majority of TC magistrates in the light of the deliberation developed this week on the Amparo Resource presented by the Vox Deputies. The appeal addressed two decisions of the Congress table, then chaired by the Socialist Meritxell Batet. One, from March 19, 2020, closed the activity of the camera, with the users against PP and VOX; and another, on April 21, rejected the allegations against the first decision.
The sentence will consider null the two agreements of the Bureau, which, according to VOX, assumed "to deliver the Chamber to the Government and to close the possibility of exercising the representation of the Spaniards and the opposition function." The agreements paralyzed the terms of ongoing initiatives, the written questions made to the Government and the request for reports.
The judgment, which predictably will be voted in the next full, arrives after the CT and hardly corrected the Government for imposing restrictions that were not possible under the state of alarm. Its intensity required that the figure of the state of emergency be used, which as highlighted by the magistrates involved a control of the most intense government by Congress.
This new sentence will be added to that reproach for the lack of control of the lower house during the first phase of the pandemic. In addition, the Constitution is also planned to declare the Magna Carta contrary to the second confinement, again to avoid the Parliamentary Control of the Government.
