Google's news aggregator had ceased its activity in Spain in 2014 with the entry into force of the new intellectual property law. Specifically, the conflict was in article 32.2 of that regulation, which established the Canon AEDE, which forced Google to pay mandatory to link and show any content of the media to the Association of Editors and Authors Cedar. That is the point that the new law, which will be published on Wednesday in the Official State Bulletin, flexibilizes.
During these last seven years, the negotiations between the parties have been continuous without reaching an agreement and leaving Spain as the first country in the world to close the Google News service. Finally, with the agreement in Brussels 2019, and almost five months later the approval by the Council of Ministers of the European Union Regulations opens the doors on their return of the confirmation of the technological giant.
In its first appearance at the Congress of the Deputies, on September 30, the current Minister of Culture, Miquel Iceta, pointed out that this delay in the transposition of the law was due to "the pandemic" as had happened in "the majority of European countries "and which in October would be approved. This new approved legislation opens, according to a statement from the Ministry of Culture, "A new related right for publishers and press authors" and guarantees "a right with its own entity, from which the publishers of press publications and news agencies are to the online uses of your press publications ".
That is, a regulation is established on the appearance of publication fragments in the news aggregators but not to rule the management regulations, it is created "the option and freedom" that each editor or owner of rights can negotiate "Direct" and "individual" or by "a collective management entity with a voluntary character" with Google and the rest of aggregators.
