Stuttgart (dpa / lsw) - A brothel operator does not have to comply with certain requirements of the Prostitute Protection Act until the final decision on the application for approval for an existing operation. This emerges from a judgment published on Wednesday by the Stuttgart Administrative Court.
The plaintiff runs a brothel in the red-light district of Stuttgart. In December 2017 he applied for permission under the Prostitute Protection Act. The municipality has not yet made a decision on this. The legal dispute was now about which requirements from the Prostitute Protection Act must be met by companies that were already operating before the law came into force on July 1, 2017.
The administrative court justified its decision with the fact that, according to the relevant regulations and the transitional regulations, existing companies should initially be able to continue operating without complex and expensive conversions. Until it is clear whether approval will be granted.
Under the law, all establishments offering sex for money must meet certain requirements. These include, for example, separate sanitary facilities for prostitutes and clients, separate living areas for prostitutes and an emergency call system where prostitutes work.
