Heilbronn (dpa / lsw) - After a fatal accident in the Ludwigsburg district and the driver's escape, the four-year prison sentence against the then 42-year-old man at the wheel remains. The judgment was final, confirmed the BGH on Monday. The man had appealed on two counts of manslaughter and attempted murder after being convicted. However, the Federal Court of Justice dismissed the objection as unfounded. According to the decision of the Karlsruhe criminal senate, there was no legal error in the judgment of the Heilbronn regional court to the detriment of the accused.
In May 2019, in the middle of the night and on a country road near Sachsenheim (Ludwigsburg district), the man drove his car from behind into a group on the side of the road. A 21-year-old died and three other young people suffered serious injuries. However, the driver had not taken care of her at the time, but had fled and only turned himself in to the police hours later.
For the allegation of attempted killing, however, it was decisive that the driver considered the occurrence of a rescue success by an emergency doctor to be possible (AZ: 4 StR 200/21), according to the BGH decision. He "accepted the occurrence of death with approval", the Senate also formulated in a previously issued further decision on this matter.
