Baden-Württemberg: perpetrator-victim compensation after penalty order against police officer

Freiburg (dpa / lsw) - In the legal dispute over a possibly racially motivated attack in Freiburg, a police officer, the alleged victim and another suspect have now settled out of court. The official paid the Latvian 2,200 euros in the course of a so-called perpetrator-victim compensation, the other accused 1,800 euros, the Freiburg district court said on Friday. The proceedings against the 46-year-old police officer and the 47-year-old were then discontinued. The police officer is said to have threatened a 37-year-old during an argument.

In the incident in June 2021, the police officer is said to have been traveling privately with a group from which the saying "Germany for the Germans, foreigners out" fell out. After the sentence, an argument broke out between the group of seven around the police officer and a 37-year-old Latvian, who referred to the words.

A spokesman for the public prosecutor's office said in May that it was not possible to determine whether the officer said that, nor could it be refuted that the sentence was a statement about a past incident. The accusation of hate speech was therefore dropped.

The two men had lodged an objection to penal orders which, according to the public prosecutor's office, would have provided for a payment of 3,600 euros in the case of the official. However, due to the number of daily rates, both would not have been considered criminal records.
