A swimming instructor has already been convicted of numerous abuses of children. The Baden-Baden district court is now hearing the case again. The imprisonment that has already been imposed is not up for debate. But whether the man will be released afterwards.

Baden-Baden (dpa / lsw) - A swimming teacher convicted of serious sexual violence against children is defending himself from Wednesday (10.00 a.m.) before the Baden-Baden district court against preventive detention. The court had imposed this in 2018 along with a twelve-year prison sentence. The Federal Court of Justice (BGH) had not objected to the verdict on the sentence as part of the revision filed by the man. However, the judges decided in 2019 that preventive detention had to be renegotiated due to legal errors.

The now 38-year-old had abused more than 30 girls between the ages of four and twelve, some of them severely. The crimes - according to the verdict more than 130 cases - happened during his swimming courses either in the water or in the changing rooms. An expert had at the time attested to the Ukrainian-born man's pedophilic tendencies and little insight and willingness to change.

Now another youth chamber has to make a new decision on the question of preventive detention. According to a court spokeswoman, a psychiatric expert was also invited. Actually, negotiations should have started in February. However, since the accused was in corona quarantine, the proceedings were postponed. A decision is expected on November 21. In contrast to imprisonment, courts do not impose preventive detention as a punishment, but as a preventive measure. It is intended to protect the population from perpetrators who are considered dangerous even after they have served their sentences.
