Stuttgart (dpa / lsw) - The Constitutional Court has overturned two controversial decisions by the Administrative Court of Baden-Württemberg on arcades. The Manheim-based court must now decide again whether the companies may temporarily open or not, as a spokeswoman for the Constitutional Court announced in Stuttgart on Thursday.

In the two urgent proceedings, the administrative judges had rejected applications for the temporary continued operation of the arcades. The Administrative Court has interpreted the protection of legitimate expectations too narrowly, the Constitutional Court ruled.

The background: Since July 1, 2021, there has been a rule that there must be a minimum distance of 500 meters between arcades and also to children's and youth facilities. As a consequence, companies have had to give up.

The Ministry of Economic Affairs had rejected criticism of the regulations in the past. Since 2012, arcade operators have had the opportunity to adapt to the new law and distance regulations.
