Würzburg/Karlsruhe (dpa/lby) - A geriatric nurse from Lower Franconia, who illegally injected two elderly women with insulin, has to be in prison for two years and ten months because of dangerous bodily harm - this has now been confirmed by the Federal Court of Justice (BGH) (Az.: 6 StR 52/22). The 6th criminal senate has rejected the appeal by the public prosecutor's office against the judgment of the Würzburg district court, as the BGH announced on Monday in Karlsruhe. The prosecution had pleaded for a prison sentence of three years and three months for two counts of attempted murder.
In October 2021, the court had convicted the then 49-year-old of dangerous bodily harm (Az.: 801 Js 20779/2). The judges in Würzburg could not identify an intention to kill in the act in a retirement home in Volkach (Kitzingen district). The public prosecutor's office in Würzburg appealed the judgment to the BGH. He now ruled that this was free of legal errors.
The German nurse admitted to administering insulin to the 81 and 85-year-old women in November 2020, although she was not authorized to give medication or injections. The seniors were taken to the hospital in a life-threatening condition, but were released a few days later. According to the BGH, the geriatric nurse wanted to get the women admitted to a hospital. She promised herself that she would be relieved of her workload.
