After a serious fall as a child into an excavation, a young man is fighting in court for compensation and treatment costs. A verdict is now awaited.

Munich (dpa / lby) - After years of going through the instances, the judgment of the Higher Regional Court is expected in the process of a boy falling into a pit in 2006. It is scheduled to be announced at 11:30 a.m. today.

The plaintiff, a young man, had fallen into an excavation in Munich when he was five years old. He suffered serious head injuries and has been dependent on intensive care since the accident. He accuses the construction company of not having adequately secured the construction site and thus being responsible for the accident.

The district court I had awarded the young man half a million euros in 2018, among other things for treatment costs and a monthly pain and suffering allowance of 1500 euros. However, the defendants appealed the verdict.

Because one of the defendants, the owner of the building plot, is dead and the responsible construction company is insolvent, according to a court spokesman, the owner's heir and an insolvency administrator are appearing in court on the defendant's side.

In April 2006, while playing with his twin sister and a friend, the plaintiff came to the construction site on his family's neighboring property and fell into the large excavation pit. Among other things, the process dealt with the question of whether the site fence was incomplete and not stable at the time of the accident. Witnesses from the neighborhood were also heard.
