Augsburg (dpa / lby) - After a fatal speeding drive at around 200 kilometers per hour, the public prosecutor's office has demanded a seven and a half year prison sentence for the driver. The prosecutor rated the frenzy in the trial before the Augsburg district court on Wednesday as a prohibited motor vehicle race resulting in death, the law provides for a maximum sentence of ten years. The public prosecutor dismissed the murder charge contained in the indictment. There was no evidence that the 28-year-old had intent to kill, he said.

The two defenders, on the other hand, only spoke out in favor of a conviction for negligent homicide and requested a maximum of four years in prison. They don't see the law, according to which you can drive a race without a second car, as being specific enough. The criminal court wants to announce the verdict on November 17th.

The 28-year-old driver is accused of having accelerated his high-horsepower car to about twice the speed on a state road near Monheim in northern Swabia, where a maximum of 100 km/h was allowed. As a result, he is said to have lost control of his vehicle and thrown into oncoming traffic.

There, the accused crashed into the car of a mother of four, and the 54-year-old died immediately. The speeding was documented in detail because the accused had installed a so-called dashcam in his car and recorded the seconds before the fatal accident on video.

The victim's family is a joint plaintiff in the case. The lawyer for the survivors joined the criminal complaint of the prosecutor. The widower of the woman who was killed was traumatized by the accident and therefore could no longer work, he said.

Also accused in the proceedings is the passenger, who is said to have cheered on the driver during the breakneck drive. The public prosecutor therefore demanded a two-and-a-half-year prison sentence for him for an accessory act. The defense attorney, on the other hand, saw no aid and only pleaded for a fine for drug offenses that were also accused.

In addition to the withdrawal of the 28-year-old's driver's license, the public prosecutor's office also demanded a lifetime driver's license ban for the man. The prosecutor pointed out that the driver already had a relevant criminal record and had previously lost his driver's license. The defendant learned nothing from this. Even after the fatal journey, he still raved about risky driving.
