Munich (dpa/lby) - Unjustified fines due to violations of corona exit restrictions in spring 2020 can possibly be reclaimed from those affected. "In cases in which the behavior punishable by the fine should not have been prohibited according to the case law of the administrative courts, a fine should also be able to be paid back if the citizens submit a corresponding application. There is consensus on this attitude in the state government Health Minister Klaus Holetschek and Justice Minister Georg Eisenreich (both CSU) said in Munich on Wednesday.

Both emphasized that after the judgment of the Federal Administrative Court last week, they consider a repayment "under certain conditions" to be possible. How this could look in detail is still open: "The regulation on how the Free State will proceed with this question is currently still in progress."

The state government is currently analyzing the verdict "carefully" and is drawing the necessary conclusions. This also applies to the question of how to deal with fines. More than 22,000 fines were imposed in Bavaria from April 1 to 19, 2020 for violations of the exit restrictions.

The Federal Administrative Court in Leipzig ruled about a week ago that the strict exit restrictions in the Free State in spring 2020 were disproportionate and ineffective. As a result, the court announced that the reasons for the judgment could probably not be served until 2023. "Regardless of this, our ministries are in agreement on how to deal with applications for the repayment of fines," emphasized the ministers.
