A teacher at a primary school in the district of Hof has filed a lawsuit against the Free State of Bavaria. She wants to have her Covid 19 disease counted as an accident at work.

According to the court, the teacher was employed in emergency care at the school in January 2021. Schools were officially closed during this time. On February 1, she had tested positive for an infection. The teacher claims that there were no cases in the group she looked after, but that she supervised several children who later tested positive. She was also in contact with a colleague who tested positive.

There was a massive outbreak in the school during this period. Privately, the teacher argued further, she had had no risky contacts. She must have gotten the infection while working at the school.

According to a spokesman, two procedures with a similar topic are now being processed at the Bavarian Administrative Court in Munich: A teacher from Lower Franconia and a police officer from Augsburg want to have a corona infection recognized as an occupational disease. The administrative courts of Würzburg and Augsburg had agreed with the plaintiffs.

According to the Administrative Court, the Free State of Bavaria was of the opinion in both appeals that the complaints should have been dismissed because the assumption of an occupational disease was incorrect. A decision in both cases is expected by the end of the year.
