A preliminary investigation into "insider trading", which was opened in February in the context of the Ehpad scandal had been launched to examine the resale by the Orpea director general before publication of a book-scandal about abuse in Ehpad. This had been announced by the national financial prosecutor's. Le Canard enchaine stated on February 2nd that Yves Le Masne had sold shares for almost 600,000 euros in July 2021 "just three weeks after Orpea management was informed about Victor Castanet’s book Les Fossoyeurs. Orpea is accused in this book of failing to manage its nursing homes properly. The group denied the allegations.
A press release was sent by his lawyer to Yves Le Masne on February 4. It stated that he had "strongly denied any accusation of insider trade". The former leader assured us that "about a third" of his shares were sold because of the book of Mr. Castanet. This did not cause any concern. He clarified that he did not intend to sell any more shares and was confident in the company's future.
