Frankfurt / Main (dpa / lhe) - In the process of two rival groups and a raid on a kiosk, the Frankfurt Regional Court has imposed four years of imprisonment. At four years and nine months, the 31-year-old main defendant received the highest sentence on Wednesday. He had fired six shots in the act in January last year in Frankfurt's Ostend, but was only convicted of serious breach of the peace because, according to the verdict, no intent to kill could be proven.
Three other defendants received prison sentences of between three years and three months, also for breach of the peace. A 24-year-old co-accused was acquitted because he could not be positively identified as the second shooter. The sixth accused received a year in prison, which he has already served with the pre-trial detention.
In a column of eight vehicles and a total of 30 participants, the attackers drove to the kiosk of the enemy group on the evening of the crime. Because the people in the bar had entrenched themselves in good time, there were no victims. The only one injured was from the group of attackers - he was shot in the leg.
The verdict said that the relatively high penalty for a serious breach of the peace can be explained by the "extreme danger" of the act. "I'm stunned how you could behave in such a situation," said the presiding judge. The accused made extensive confessions in court, but denied the intention to kill. The jury also saw her appearance as merely a "threatening gesture and intimidation".
The verdict is not yet legally binding. The public prosecutor had pleaded attempted manslaughter and demanded higher prison sentences.
