With a decision published on Monday, the Higher Regional Court (OLG) Frankfurt rejected the application for admission of the complaint against the local court's conviction of the AfD politician to the fine. The Higher Regional Court announced that the district court's decision was final. The court did not say who it was.

The AfD member of parliament was in the public area of ​​the publicly accessible building in November 2020 in connection with a district council meeting. Because he was not wearing a mouth and nose cover, the district imposed a fine of 100 euros on him for violating the Corona Contact and Operating Restriction Ordinance, the OLG explained. Upon the objection of the person concerned, the District Court upheld the fine. An application for admission of the legal complaint against the decision had been rejected by the OLG, it said. There are no grounds for admission. In order to contest the decision, the refusal of a legal hearing could have been considered as a complaint. However, this was not collected, so the decision of the district court is final, explained the OLG.

A spokesman for the AfD parliamentary group said that the person concerned did not appear in his capacity as a member of the state parliament, but as a member of the district council in the building.
