Hessen: No persecution? Refugee sues against BAMF decision

Frankfurt/Main (dpa/lhe) - In his native Algeria he could not live openly as a homosexual, as a refugee in Germany he is involved in the queer community. However, the Federal Office for Migration and Refugees (BAMF) rejected the follow-up application from the man living in sheltered accommodation in Frankfurt. This Tuesday, the Frankfurt administrative court is dealing with the case because the refugee has appealed the decision.

The 35-year-old campaigned for the rights of homosexual refugees both in the media and at public events and spoke about the persecution of homosexuals in Algeria. His first asylum application was rejected in March 2020. At that time, the reason given was that the risk for homosexuals in Algeria was not so significant that "persecution relevant to refugee protection" could be assumed. A follow-up application after a wave of arrests of homosexuals in Algeria in 2020 was also rejected by the BAMF.
