Mecklenburg-Western Pomerania: Court confirms forced leave for Lützow military commanders

Schwerin/Lützow-Lübstorf (dpa/mv) - The leader of the Lützow volunteer fire brigade failed before the administrative court in Schwerin with his urgent application against a work ban by the municipality. The decision of the municipality was made lawfully, the court announced on Thursday in Schwerin. The head of the Lützow-Lübstorf office had previously prohibited the man from continuing his official business because there was suspicion of serious misconduct. However, no specific details were given.

The decree, which will be valid from December 15, 2022, will remain in effect for the time being. However, the decision is not yet final, an appeal to the Higher Administrative Court is possible.

According to the announcement, the administrative court also justified the decision with the fact that the military leader, as an honorary civil servant and employee with a managerial function, must work together with the community in a spirit of trust. That trust has been shaken.

According to the information, the municipality is legally permitted to order the military commander up to three months of compulsory leave and to prohibit them from conducting official business, entering the fire brigade equipment houses, driving emergency vehicles, wearing work clothes and equipment and staying in the official rooms.
