The background: The driver of a sports car had received a fine of 128 euros (of which 28 euros was an administration fee) because he was allegedly observed by a police officer on a motorcycle in the Heinrich-Heine-Allee/Operngasse area while driving without permission used the cell phone and made calls. On the other hand, the 43-year-old driver appealed. There was a hearing before the Düsseldorf district court, which was broken off on Monday without a verdict.
The accused's lawyer doubted that the policeman, sitting on the motorcycle, could look into the extremely flat sports car, which is said to be only 1.20 meters high, in such a way that the alleged cell phone violation could be recognized without a doubt. His client did not use a mobile phone while driving, but only operated a switch on the control panel on the dashboard of the car. The police officer, on the other hand, said, according to the media: "If I hadn't been absolutely sure, I wouldn't have written a report."
To get to the bottom of this question, the judge ordered a local appointment to take place in October. Then the 43-year-old and the 41-year-old motorcycle policeman would have to appear on site with their vehicles to recreate the situation, said the court spokeswoman.
