North Rhine-Westphalia: Manufacturers are no longer allowed to advertise with reference to Corona

Bielefeld/Düsseldorf (dpa/lnw) - A manufacturer of a mouthwash from Bielefeld is no longer allowed to advertise its product with a corona reference. This was decided by the district court of Bielefeld. There was thus an action for an injunction by the NRW consumer center, as the consumer center announced on Friday in Düsseldorf. According to the district court, the judgment is not yet final.

The consumer advocates had seen a violation of the Medicines Advertising Act in statements such as “The risk of droplet transmission of the corona virus is reduced” or the phrase “Corona prophylaxis”. According to this law, advertising for medical devices outside of professional circles must not refer to the prevention or alleviation of certain diseases.

In a statement, the manufacturer of the advertised product emphasized that the proceedings only dealt with the question of whether the advertising statement to consumers is permissible. The consumer center did not question the effect of the product, said a spokesman for the Bielefeld cosmetics and drug manufacturer Dr. Wolff. It was initially unclear whether the company would appeal the verdict. When the verdict is in writing, further steps will be considered, the spokesman said.

According to its own statements, the NRW consumer advice center had already warned the company at the end of April 2021. After it did not sign the cease-and-desist declaration, the consumer advocates complained.
