"Pictures of Contemporary History": Becker fails with lawsuit against Pocher

The Offenburg district court dismisses the lawsuit brought by Boris Becker, who is in custody in Great Britain, against comedian Oliver Pocher. The TV report, which allegedly violated the ex-tennis star's personal rights, does not have to be deleted for the time being.

Former tennis star Boris Becker failed in court with his injunction action against TV comedian Oliver Pocher. The Offenburg district court decided that Becker's personal rights would not be violated by a television contribution by the comedian, as a spokeswoman said after a hearing. Neither Pocher nor Becker, who is in a British prison for delaying bankruptcy, had to appear in court for this decision.

A television report from the RTL program "Pocher - dangerously honest" from October 2020 was controversial. A call for donations was started under the slogan "Make Boris rich again". According to the court, it can be seen that Becker also received the money – but without knowing about it. The money was incorporated into a supposed fashion prize that was awarded to the 54-year-old on the show.

"The plaintiff did not know that the prize was created and awarded to the plaintiff for the sole purpose of sending him the collected cash amount - hidden in the prize trophy," explained a court spokeswoman. According to his Offenburg lawyer Samy Hammad, Becker demanded that the post no longer be broadcast and deleted from the Internet.

However, the publication is possible because it is about "portraits of contemporary history", according to the court. It also explicitly mentioned the concerns of freedom of expression and freedom of broadcasting. The judgment is not yet final.
