Saxony-Anhalt: climate activist does not have to pay for demo costs

Naumburg (dpa/sa) - A meeting leader of a climate demonstration does not necessarily have to pay for the cleaning costs for removing spray chalk. The Higher Regional Court of Naumburg confirmed a lawsuit dismissed by the Stendal Regional Court in a decision on Monday. The Higher Regional Court announced this on request.

The background was an action by Fridays for Future in March 2021 in Stendal. There, the participants were provided with water-soluble spray chalk, but some participants also brought their own products, said a spokeswoman for the higher regional court. After the demo, the city asked Fridays for Future to clean the marketplace. This was unsuccessful, according to the information, the city initiated cleaning and sanitation measures. The chairwoman of the meeting should pay the costs of around 9,000 euros.

The Stendal District Court dismissed a corresponding lawsuit, and the Higher Regional Court confirmed the decision on Monday. The defendant would only be liable for damage if it were found that she herself used the chalk, said a spokeswoman. "And that's hard to tell." In addition, the different chalks have different solubility. So the attribution fails.
