Chemnitz (dpa/sn) - People with disabilities have a financial right to be accompanied if they cannot visit relatives without outside help. "The visit allowance in the form of personal assistance can be provided in individual cases as an integration aid if it is necessary," said the Saxon State Social Court in a decision published on Monday, thereby confirming the opinion of the Dresden Social Court.

A 54-year-old man who lives in a residential home for people with disabilities had complained. Every two weeks, over the weekend, he visits his 90-year-old mother, who lives in another city. "He needs help to cope with these trips due to mental illness," it said. In 2018, the municipal social association of Saxony, as the responsible social welfare agency at the time, rejected the assumption of the costs for such assistance, since the plaintiff's needs were already covered by the assumption of the costs of accommodation in the home.

The judges in Dresden and Chemnitz now saw things differently. The state social court announced that the severely disabled plaintiff was dependent on personal assistance to visit his mother and maintain contact with her. "The main goal of integration assistance is to counteract the isolation of disabled people." In the opinion of the court, an interim new regulation in the law on integration assistance does not change anything about the claim. A revision was allowed.
