Thuringia: Administrative court rejects lawsuits

Meiningen (dpa/th) - The administrative court in Meiningen has dismissed lawsuits from the districts of Sonneberg and Hildburghausen for financial equalization of the state with the municipalities. The two municipalities had considered the financial resources of the districts to be insufficient and considered the regulations in the Thuringian Financial Equalization Act to be unconstitutional, as the court announced on Thursday.

The administrative court dismissed the lawsuits on Tuesday. "The Chamber was unable to recognize that the legislature had not sufficiently observed the procedural requirements derived from the Thuringian constitution with regard to the regulations of the Thuringian Financial Equalization Act challenged by the plaintiffs," the statement said. The court therefore refrained from submitting the legal disputes to the Thuringian Constitutional Court for a decision. The judgments of the Administrative Court can be appealed to the Higher Administrative Court.
