Thuringia: brutal knife attack: procedure is reopened

Gera (dpa/th) - After a brutal knife attack in Gera, one of the three defendants has been on trial again since Tuesday. The then 15-year-old is said to have injured two men in the face with a cutter knife in February 2020 and accepted their deaths, according to the Gera district court. In July 2020, he was sentenced to five years in prison for attempted manslaughter in combination with serious and dangerous bodily harm. On the other hand, he appealed.

The Federal Court of Justice (BGH) partially overturned the judgment in May 2021, which is why the matter has to be heard again in Gera. Among other things, the BGH complained that the district court only included the opinion of one expert in the judgment on the question of incapacity due to the alcohol level of the accused and left out the considerations of another expert.

Two other young men were also involved in the attack on a February night in 2020. The trio attacked two players with punches and kicks. The co-defendants, aged 21 and 19 at the time, received suspended sentences of one year and one year and three months. The judgments are now final.
