After a fatal speeding drive at around 200 kilometers per hour, the public prosecutor's office has demanded a seven-and-a-half-year prison sentence for the driver. The public prosecutor rated the frenzy in the trial before the Augsburg Regional Court as a prohibited motor vehicle race resulting in death, the law provides for a maximum sentence of ten years.
However, the public prosecutor dismissed the murder charge contained in the indictment. There was no evidence that the 28-year-old had intent to kill, he said. The two defenders, on the other hand, only spoke out in favor of a conviction for negligent homicide and requested a maximum of four years in prison. They don't see the law, according to which you can drive a race without a second car, as being specific enough. The criminal court wants to announce the verdict on November 17th.
The 28-year-old driver is accused of having accelerated his high-horsepower car to about twice the speed on a state road near Monheim in Swabia, where a maximum of 100 km/h was allowed. As a result, he is said to have lost control of his vehicle and thrown into oncoming traffic. There, the accused crashed into the car of a mother of four, and the 54-year-old died immediately. The speeding was documented in detail because the accused had installed a so-called dashcam in his car and recorded the seconds before the fatal accident on video.
