Nursing homes are not allowed to simply throw residents out the door. The "important reasons" granted by the legislature are rare. One wording in particular is often found, but rarely has a sound justification.

The termination of nursing home residents by home operators is only effective in absolutely exceptional cases. That's why it's definitely worth fighting back. This is pointed out by the consumer advice center in Berlin. There is no ordinary termination by home operators. Only written terminations for important reasons are permissible.

This is the case, for example, when operations are discontinued. Or if professional care is not possible after a change in health and the home has effectively ruled this out for the specific case. Or if a resident repeatedly fails to comply with a contract change to adjust the benefits to an increased need for care.

A delay in payment of two months and a reasonable payment deadline set by the operator, which was not observed, are also valid. However, a company cannot terminate the contract in order to enforce a wage increase. If a person living in the nursing home persistently and imputably ignores the rules set out in the nursing home contract, the company may also terminate without notice.

Important: In order for the termination to be effective, the continuation of the supervisory relationship must represent an actually unreasonable burden for the company. According to the consumer advice center, this is regularly stated in notices, but is rarely really valid. Ringing the bell a few times too often is definitely not enough. A high level of maintenance is also no reason.

Anyone who suspects that a termination is not justified should reject it as invalid. In practice, there are always different assessments, especially when it comes to the question of culpable violation of the rules of the home. The consumer advocates recommend that you seek advice if you are terminated by the home. The advisors from the consumer advice centers can also help with this.

By the way, residents can terminate their home contract without giving reasons. This can be done up to the third working day at the end of the same calendar month.
