Karlsruhe/Offenburg (dpa/lsw) - A father who is said to have offered his three-year-old daughter for abuse on the Internet and who is said to have violated her himself must go back to court. With a decision published on Monday, the Federal Court of Justice (BGH) in Karlsruhe ordered another youth protection chamber of the Offenburg Regional Court to deal with the case again.

In the first trial, the court had sentenced the then 39-year-old to four years in prison for, among other things, serious sexual abuse of children and the production of child pornography. From the BGH's point of view, the sentencing was "completely incomplete". Among other things, it is about whether the payment of compensation for pain and suffering of 10,000 euros should be considered as a mitigating sentence and to what extent the man took responsibility despite an incomplete confession.

According to earlier information from the public prosecutor's office and the Baden-Württemberg State Criminal Police Office, the investigators received a tip in July 2021 that a child was being offered via a platform. The father was then taken into custody. Investigators searched his apartment in the Ortenau district and secured child and youth pornographic files and other evidence.

According to a court spokeswoman, the accused had protested during the trial that he was sorry. According to the information, his defense attorney had applied for a total prison sentence of no more than two years on probation. The public prosecutor's office, on the other hand, had pleaded for six years and three months.
