Hesse: Court rejects lawsuit after controversial cosmetic treatment

Wiesbaden/Frankfurt (dpa/lhe) - Two "black bars" instead of beautiful new eyebrows: Since he was dissatisfied with the result of his cosmetic treatment in a Wiesbaden studio, a man went to court. However in vain. The Frankfurt Higher Regional Court (OLG) saw no justifiable defect in the treatment with so-called permanent make-up, as a spokeswoman announced on Monday. The "differences in taste" alone were not enough, because the plaintiff had to accept "artistic design leeway".

The man had already failed in the Wiesbaden district court with his request to win 3500 compensation for pain and suffering and reimbursement of the costs for corrective treatment. On the decision of the OLG, he withdrew the appeal, the decision was final, said the OLG spokeswoman.

The judges argued, among other things, that there were no specific guidelines for the treatment. On the contrary: the man confirmed with his signature, among other things, that the permanent make-up had been drawn out before the pigmentation and shown in a mirror. The same applies to the approximate color. In addition, he signed a kind of "acceptance" for the final result, paying 280 euros.

Only later did he complain that the pigmentation disfigured him, that "two black bars" were tattooed at the level of the eyebrows. The Higher Regional Court judges, on the other hand, declared that the plaintiff had not proved that the "bar-shaped tattoo with a pointed end" deviated from the agreement with the cosmetic studio.
