Police officers must stand up for the free democratic basic order at all times. Doubts had recently arisen among four LKA officials. A court has now made a decision on a police officer who is no longer allowed to do his job.

Magdeburg (dpa/sa) - The suspicion of extremism against four officers of the State Criminal Police Office made headlines in January: Now one of them, who was temporarily prohibited from conducting official business, failed before the Magdeburg Administrative Court. The court had rejected the bodyguard's application for temporary legal protection, it said in a statement on Wednesday. The civil servant had to accept the provisional ban on conducting official business for the time being.

The public prosecutor's office rejected criminal investigations in January because they were time-barred. However, disciplinary proceedings are underway, among other things, on suspicion of violating the duty of loyalty to the constitution.

Regarding the accusation, the administrative court said: The officer who works in the field of personal protection commented approvingly on a WhatsApp message with the thumbs-up symbol. A picture with a woman lying on a couch with a free lower body and a young man could be seen. He turns away from the woman and looks at a television with a picture of Adolf Hitler. The picture bears the subtitle "There are things that are simply more important ...".

The court decided that the employer could not be expected to leave the officer on duty until the final clarification and decision. The public has the right to only use law enforcement officers whose personal integrity is beyond doubt. The positive reaction to National Socialist ideology is a strong indication of serious character aptitude deficiencies.

The court made it clear that this was not an ironic-critical portrayal and also not a tasteless sexist joke, but a glorification of Adolf Hitler as a person. The official did not actively oppose this glorification, but expressed his sympathy with a thumbs-up. The decision is not yet final.

In mid-January, the Ministry of the Interior made public that the evaluation of another person's mobile phone revealed bilateral contacts and communication processes in which National Socialism was played down. Criminal investigations were initiated against four officers of the State Criminal Police Office on suspicion of extremism. Just a few days later, the Magdeburg public prosecutor declared that the alleged content was created between 2015 and 2017 and was therefore statute-barred. There are no prerequisites for criminal prosecution.

The LKA had forbidden the two officials from the area of ​​personal protection to conduct official business. The other two officials have been transferred to office work. Disciplinary proceedings were also initiated against all four.
