Aschaffenburg (dpa / lby) - The acquittal of Lower Franconia's District President Erwin Dotzel from the allegation of insult is final. This was announced by the regional court in Aschaffenburg on Wednesday. The public prosecutor's office has withdrawn its appeal against the judgment of the Obernburg am Main district court (Miltenberg district) of August 25.

The public prosecutor's office had accused Dotzel of having described a party friend as a "right louse" in a group chat of the CSU local branch in Wörth am Main last September. According to the verdict, however, it could not be proven that the district council president had intentionally put the message in the group chat. It is also possible that this was a mistake and that the defendant actually wanted to send the message to someone else. In this case, the protection of privacy applies, according to the court.

The hearing came about because Dotzel had lodged an objection to a penalty order from the district court. Accordingly, he should pay 20 daily rates of 160 euros for insults.

In July, Dotzel was sentenced to pay compensation of 750 euros to the alleged victim in civil proceedings before the Aschaffenburg district court. However, both sides have appealed. Since then, the Higher Regional Court of Bamberg has been examining the case.
