Bavaria: Authority: Photographing illegal parkers is not a license

Ansbach (dpa / lby) - According to the Bavarian data protection officials, two court rulings on photographing illegal parkers should not be understood as carte blanche. The state office for data protection supervision announced on Monday that anyone who takes such pictures is still not exempt from the requirements of data protection. It referred to the reasons for two judgments of the Ansbach Administrative Court in November, which are now available. In it, the court emphasized that the photographing of uninvolved passers-by in the vicinity of illegally parked vehicles should be avoided.

On November 2, the court ruled in two cases for two men who had backed up their reports of parking violations on sidewalks and cycle paths with photos. They therefore received a warning from the Bavarian State Office for Data Protection Supervision - together with a fee of 100 euros each. On the other hand, the two went to court, which had combined the two proceedings. The verdict stated that the procedure involved lawful data processing.
