Dresden (dpa/sn) - The Dresden traffic turnaround initiative is not allowed to demonstrate with a bicycle parade on the Autobahn 4. The Higher Administrative Court (OVG) in Bautzen rejected an appeal against the ban on Friday. The environmentalists wanted to protest against an expansion of the highway early on Sunday morning. The bike parade should also take the A4 between Hellerau and Dresden Airport.

The city of Dresden, as the assembly authority, had only approved a demo route away from the autobahn. The city had justified the decision by the necessary blocking of the A4, which could lead to traffic accidents and thus endanger life and limb for motorists.

On the other hand, the organizers had initially unsuccessfully sued the Dresden Administrative Court. The OVG has now confirmed the ban. The determination of the alternative route is legal, the basic right of freedom of assembly is not violated, the court said. No further appeal can be lodged against the decision (Ref.: 5 B 195/22)

The alliance Verkehrswende had already made an attempt last year to protest against the expansion of the Autobahn. The fundamental right to freedom of assembly also includes the choice of location and must also apply on a motorway, the organizers argue. Even then, however, they had failed in court.
