The Prosecutor's Office had requested a sentence of two years and six months in prison.

In addition, the Criminal Court No. 18 of Madrid, has sentenced the defendant to four years of isolation from the victim and to compensate Carlota Prado with 6,000 euros, an amount for which the producer of the program, Zeppelin, must respond as civil liability. subsidiary, since both the convicted person and the victim were hired by it.

Zeppelin, along with Choup European Group, the insurance company contracted for that edition, has also been sentenced to compensate the young woman with 1,000 euros for the "moral damage" caused by "notifying her of the crime of which she was the object." It refers to the moment when those responsible for the production company took Carlota Prado to what is known as the confessional and showed her the images of the sexual abuse of which she had been a victim the night before.

On September 19, 2017, both entered the house as full-fledged contestants of GH Revolution, the latest anonymous edition of the reality show. She entered the house with only 24 years. Born in Estepona, Carlota Prado came to GH after leaving the night as the director of two nightclubs in Marbella and after having dozens of adventures. José María López, for his part, also enters the house at the age of 24 from the Murcian town of Torre Pacheco where he was engaged in agriculture.

What months before that night of November 4, 2017 had begun in a dream for Carlota Prado ended up turning into the young woman's worst nightmare. Judge María Dolores Palmero Suárez considers it proven that on November 3, 2017 at 8:00 p.m., a few hours before José María López abused an unconscious Carlota Prado, the program organized a party in which it supplied the contestants with alcoholic beverages, as could be seen then in the summaries of the program.

The sentence relates that "during the said party, Carlota Prado, who had only had a plate of chips for dinner because there was a shortage of food in the house, drank an indeterminate amount of alcohol, no less than four shots of tequila or similar liquor , which led to alcohol poisoning, which worsened after midnight". Carlota Prado did not receive medical assistance, rather it was her defendant who took her to her bedroom.

At 1:30 a.m. on November 4, José María López took off his pants, helped Carlota Prado to take off her shoes and get into bed and, "guided by a lewd spirit, knowing the state in which Carlota Prado was, He took off her pants and began to make movements of a sexual nature under the duvet, despite the fact that she weakly told him "I can't".

While Carlota Prado took off her shirt, the defendant "squeezed her body to satisfy her sexual desire," the sentence describes, "despite the fact that she even raised her hand on two occasions, wanting to tell her to stop." Carlota Prado remained motionless until José María López asked her how she was doing. Carlota Prado tells him to get out, but then he covers them both with the duvet and begins "to make sustained rhythmic movements that denote, at least, that the defendant is masturbating in Carlo Prado's body without sufficient proof." that he penetrated her vaginally or anally".

At 1:40 a.m., those responsible for the program call the defendant's attention in a "quite laconic way", who tries to wake up the victim, who wakes up in a daze, vomits and "shows wobbly". For this reason, the judge considers that "it is obvious that Carlota Prado was deprived of all meaning and" in deplorable conditions. to satisfy itself as a sex toy".

The sentence, in addition, is very forceful with the defense allegation that she was "highly requested previously": "As the accusation crudely describes, the complainant was used as an object for the satisfaction of the defendant's libido."

"Nor is it noticed in the recording, as the defense says, that mutual abdominal movements are evident, since what is clearly appreciated is the completely absent and passive attitude of the complainant," the letter concludes.

Regarding civil liability, the judgment splits it into two causative events: one, the sexual abuse itself, which generates damage subject to compensation, and the other, the exhibition to the injured party by the entity that produced the recording made without prior notice. or preparation, which generated frustration, moral damage and subsequent psychological consequences.

The convicted person is responsible for the first and for the second "only direct responsibility of the Zeppelin entity can be predicated, whose managers are those who decide to show the recorded footage to the young woman," the judge concludes.

It is demonstrated that the fact that the young woman saw the images alone, in the confessional, with no other company than the voice-over of the man known as Super, without prior knowledge or notice of what they were going to show her, without "assistance of any personnel and without any contractual clause that regulates the procedure", generated in her "frustration, moral damage and, apparently, subsequent psychological consequences".

"In these conditions, the viewing of what had happened caused in Carlota Prado, already fully conscious, the next morning, a deep discomfort, surprise and pain and, later, anxiety and stress that ended up producing a psychological disorder in later dates" , the letter states.

After speaking with the psychologist that morning, Carlota Prado decided to leave the house.
