Munich (dpa / lby) - After a young cow was attacked on an alpine pasture near Tegernsee, a hiker received no compensation and no compensation for pain and suffering. This was decided on Thursday by a civil senate of the Munich Higher Regional Court (OLG). According to the judges, the mountain farmer is not responsible for the attack of the cattle (Az. 1 U 724/22).

The hiker had sued the alpine farmer because she had suddenly been pushed to the ground by the cow on a path in the mountains. The plaintiff reported a large bruise and pain. She demanded 6,000 euros from the cattle farmer.

The district court in Munich had decided that the lawsuit was justified in principle. However, the Higher Regional Court Senate disagreed with this view. He did not assume that the farmer's wife had created a dangerous situation by leaving a calf in the herd and was therefore responsible for the animals' unrest. The plaintiff cannot therefore claim any compensation.
