Munich (dpa / lby) - The Munich I Regional Court is dealing with a failed mask deal by the Bavarian state government at the beginning of the corona pandemic today (9:00 a.m.). An entrepreneur from Lower Franconia sued the Free State because a planned deal with FFP2 masks did not come about after all. According to the court, it is about the sum of 1.5 million euros.

The plaintiff explained that he had made financial advance payments because he had trusted that the "contract that had been negotiated almost to the end" would also be definitively concluded. However, the Free State of Bavaria did not sign the contract for no understandable reason.

The Free State had rejected this representation according to the court. The mask prices fell sharply back in April 2020, which is why the Free State simply decided on a cheaper offer, it said. From a state perspective, this is a reasonable reason to withdraw from the planned deal. In addition, the State Office for Health and Food Safety classified the masks as “not marketable”.
