Seefeld (dpa / lby) - Only six square meters separate the property of a couple from the Pilsensee - but for the coveted access to the water, the owner of the tiny property wanted more than the 30,000 euros that the couple had offered. The owner felt that this was not enough in view of the expected increase in value. Since the spring of 2022, both sides have been negotiating, among other things, about the purchase of this property - the dispute ended up before the Munich II District Court.
According to court reports on Friday, the couple lives in a single-family house on a property without lake access in Seefeld in the Upper Bavarian Five Lakes region. At the same time, the couple owns a tubular property with direct access to Lake Pilsen. But access is via the six square meter spot that the couple does not own.
In the winter of 2022, the owner banned the couple from entering the property. Because she argued that an agreement on the use had to be reached first, the couple went to court and applied for a temporary injunction to be granted a right of way. The couple stated that there was no public road leading to their lake property and that weather-sensitive objects such as boats had to be stored.
On February 3, the property owner agreed to enter the property for storage in view of the impending damage. A civil division of the district court denied the application for an injunction. In view of the concession, the necessary urgency was lacking. The decision is not final.
