Düsseldorf (dpa / lnw) - A controversial police boiler at a demonstration in Düsseldorf is now occupying the Higher Administrative Court (OVG) in Münster almost a year and a half later. This was confirmed by a court spokeswoman on request.

In June 2021, during a protest march against the new assembly law planned at the time, there were clashes between demonstrators and the police. At the time, the police arrested around 300 protesters in a place where it was comparatively quiet. Wrongly so, according to three applications from those involved that were submitted to the Düsseldorf Administrative Court (VG).

The Düsseldorf court has not yet been able to clarify this substantive question - since the Düsseldorf police as the defendant have questioned the fact that the administrative court is responsible. Rather, the district court is the right address. The Higher Administrative Court should now decide where to proceed and which court is actually responsible. The plaintiffs accuse the state of intentionally delaying the matter. From their circles it was said that the legal battle was a "delaying tactic" by the police as a state authority.

The Düsseldorf police, in turn, informed dpa that there could be "no question" of a delay in the procedure. One has an interest in getting "quick final judicial confirmation of the legality of the police action". However, the question of jurisdiction was complex and had been answered differently in other cases.
