Ratingen (dpa / lnw) - A teacher who appeared as a speaker at lateral thinkers demos failed in court against one of his former students. The student had informed the management of two schools in Essen and Ratingen, where the teacher was teaching at the time, about the official's statements and activities. As a result, the teacher, upon learning of this, sued him for refraining from disseminating a number of statements.

The Ratingen district court dismissed the complaint of the high school teacher in full, as a court spokesman reported on Monday (Az.: 10 C 161/22). The news portal "t-online" reported first.

The court agreed with the former student, who has now successfully completed school: his statements are covered by the fundamental right to freedom of expression. The court was not able to determine any untrue factual allegations or violations of personal rights.

As class representative, the student had said, among other things, that the teacher had appeared as a speaker at lateral thinker demos and was a supporter of "an anti-Semitic and right-wing movement". He also subliminally conveyed his views in class. So he asked a student who had reported sick to him to see if there was a connection with "the mask".

According to the court, the student asked the school administration for discretion when he asked them to check whether the official was endangering the school's duty of neutrality and whether his appearances were questionable under civil servant law. This is permissible. The verdict is not yet legally binding.
