The dispute over the chief post at the Stuttgart Higher Regional Court is coming to a head. The Judge Selection Committee feels left out. This SPD now wants him to be able to take part in the urgent procedure.

Stuttgart (dpa / lsw) - In the legal dispute over the top post at the Higher Regional Court in Stuttgart, the SPD wants to get the judge selection committee on board. The SPD politician Boris Weirauch applied to the administrative court for the panel to be included in the pending summary proceedings. Justice Minister Marion Gentges (CDU) is using her lawsuit to prevent the convening of the judges' selection committee, which the law set up as a decision-making body in the event that there is no agreement between the justice department and the Presidential Council, criticized Weirauch in Stuttgart. He is himself a member of the electoral committee.

The CDU politician is opposed to the proposal by a body made up of judges and brought up another candidate as the new president of the Stuttgart Higher Regional Court. However, because this was rejected by the so-called Presidential Council, the ministry has applied for an injunction so that a court can decide on the question. The competent chamber of the administrative court must now decide on the additional summons, as a court spokesman announced. Furthermore, it is completely open when the court will deal with the complex issue. The average duration of urgent proceedings is between two and three months.

The Judiciary Committee in the South West consists of 15 members, including six MPs. The Minister of Justice or her permanent representative presides, but has no voting rights. Weirauch said lawmakers should do everything they can to ensure the lawful process of selecting judges is followed. "The minister apparently shies away from the discussion in the judiciary selection committee. Apparently she herself doesn't seem to believe that her preferred candidate will meet with approval there."

The process surrounding the OLG candidacy and the successor to Cornelia Horz is a rarity in recent judicial history. The previous Higher Regional Court President retired in May.

Gentges had favored Beate Linkenheil for the vacant OLG line post - and suggested it to the Presidential Council of Judges. He may check whether there are errors. There, however, the department head in the Ministry of Justice was rejected. The Presidential Council spoke out in favor of Andreas Singer, the President of the Stuttgart Regional Court.
