Bavaria: Deggendorf murder trial: judges are pushing for a timely end

It is a complex process before the Deggendorf district court: the violent death of a young woman is being tried for a second time. It's about murder. After repeated delays, the end is now in sight.

Deggendorf (dpa / lby) - In the Deggendorf retrial for the killing of a young woman from the Bavarian Forest in 2016, the judges are pushing for a timely end to come to an end. In the process, which has been running since April, dates for pleadings and verdicts were set several times, but then postponed due to new requests from the defense attorneys at short notice. The verdict is now to be pronounced at the end of September or beginning of October, as the parties to the proceedings agreed on Tuesday before the Deggendorf district court.

The presiding judge made a clear statement that further applications could only be made until the end of the next day of the hearing on September 15th. There is concern that the conclusion of the procedure is being delayed "without justifiable reason".

Last Thursday, the defense had the former family doctor of the 28-year-old defendant summoned as a witness. It was about the question of a possibly limited ability of the man to control and act at the time of the crime.

The doctor now said that the accused had visited him a few weeks before the crime and had been in a "psychovegetative state of excitement" due to the previous separation from his girlfriend - and thus from his son. According to his perception, however, this had no effect on the ability to act. The patient was "basically capable of anything". At the time, however, he gave him a short sick leave, the doctor said.

The accused stabbed his 20-year-old ex-girlfriend six years ago. He was sentenced to 12 years in prison for manslaughter in 2017. Due to false statements by two witnesses in favor of the accused in the first trial before the district court of Passau, the proceedings have been resumed. The 28-year-old is accused of murder in the second trial.

The further planning of those involved in the proceedings now envisages hearing the forensic expert again on September 15, who had examined the accused in these proceedings. After that, the taking of evidence should be closed if there are no more applications. On September 19th, the public prosecutor's and co-plaintiffs' pleadings could begin.
