Ansbach (dpa / lby) - The administrative court in Ansbach has overturned a lawsuit regarding the planned expansion of the Frankenschnellweg in Nuremberg. A court spokesman said on Thursday after the hearing that there was no written justification for the verdict. The city of Nuremberg is planning to convert the busy Frankenschnellweg into a kind of city freeway without crossings for around 660 million euros.

The environmental association VCD in Bavaria had sued in 2020 against the change in the planning approval decision and the environmental impact assessment because, among other things, the underlying traffic forecast and the pollutant measurements were incorrect in its opinion. It would also disturb bats in their resting places.

The decision of the administrative court is not yet final. The Bavarian Administrative Court (VGH) would have to decide whether to allow an appeal. However, it could be that the VCD refrains from an appointment for financial reasons, said the chairman of the regional association Greater Nuremberg, Christoph Wallnöfer.

The Bund Naturschutz (BN) is also suing the VGH against the expansion of the Frankenschnellweg. A date for the oral hearing is currently not foreseeable, a spokesman said when asked.

In 2015, the VGH had given the lawsuit hardly any chance of success in the oral hearing. The BN then negotiated a compromise with the city, which includes better noise protection and a speed limit. In a member survey, however, a majority of the Nuremberg district group rejected the settlement, so that the BN is maintaining the lawsuit.
