Gießen (dpa/lhe) - The Gießen labor court has again dealt with the case of two nursing home employees who were released from their job due to a lack of corona vaccination certificates. The two men are complaining that they will continue to receive their salary during the period of leave. At the conciliation hearing on Thursday, no agreement was initially reached, a court spokeswoman said. The lawsuits are now to be heard again in November – then a decision is expected.

The so-called facility-related compulsory vaccination for employees in clinics, practices or nursing homes has been in effect since mid-March. They had to prove their vaccination status or recovered status by March 15th - or submit a certificate stating that they could not get the syringe for medical reasons. The implementation of compulsory vaccination in Hesse takes place in several stages. The regulation is only intended by law until the end of the year and would be canceled if the Infection Protection Act were not changed again.

The two plaintiffs had not presented their employer - a retirement home in Pohlheim in central Hesse - with any vaccination certificates. They were then released without continued payment of salary.

The labor court had already dealt with the case in an urgent procedure in April. At that time, the plaintiffs wanted to continue their contractual employment, but the question of salary was not yet an issue. The Labor Court dismissed the claims. However, the main decision is still pending. In addition, the appeal against the decision in the summary proceedings is still pending.
