Mönchengladbach (dpa / lnw) - Almost a year after the violent death of a homeless man in Mönchengladbach, the regional court there sentenced two men to six years in prison each. The men from Poland were charged with murder but were convicted of causing serious bodily harm resulting in death. The intention to kill could not be proven, the court said on Thursday when the verdict was announced. In addition to the prison sentences imposed, she was placed in a rehab clinic because of her alcohol addiction.
The 37- and 38-year-old men had confessed to having severely beat and kicked the victim under the influence of alcohol together with another perpetrator in a dispute over money. "With the confession, they saved themselves some imprisonment," said the presiding judge to the accused.
According to the conviction of the criminal court, the duo had planned a revenge action with another accomplice on the night of September 23rd. The reason was that they had given the 38-year-old compatriot money to go shopping, but he had embezzled the money. In contrast to the accused, the victim was not banned from entering the supermarket. According to the opinion of the expert, the accused were heavily intoxicated during the night and therefore only partially responsible at the time of the crime.
Both also come from the homeless scene. The police had been looking for them with an international arrest warrant. One had been arrested in Rotterdam, the other in Poland.
