One year in prison is the sentence faced this Tuesday by the man who slapped his wife in the middle of a live stream on the TikTok social network when she was talking with three other young people, a video that ended up going viral and led to her arrest during a few hours from the author of the aggression.

The Criminal Court number 1 of Soria will host this hearing after the defendant rejected in early February an agreement in accordance with the Prosecutor's Office in the speedy trial he underwent after his arrest before the Court of First Instance and Instruction number 3 , with jurisdiction over Violence against Women.

The Prosecutor's Office requests for him a year in prison for a crime of abuse, according to articles 153.1 and 153.3, and the deprivation of permission to carry weapons for three years, in addition to the prohibition to approach and communicate with the victim during the same period of time.

In the video that led to the opening of these legal proceedings, a TikTok user could be seen receiving a strong slap in the face while she was chatting live with three young boys. At the time of the attack, the victim stated that her father had hit her, although in a later interview she explained that it was her partner who had slapped her.

Given the repercussion of these images, the man appeared at the offices of the Soria Provincial Police Station to communicate that, as a result of that video and because of the scope it was having, they were receiving many threats and insults. However, after inquiries from the agents, the Police decided to arrest him as the alleged perpetrator of the attack.

Shortly after the speedy trial was held, but the defendant accepted his right not to testify, like his partner, who also waived any protection measure, as well as to have legal assistance and to be recognized by the forensic doctor. Faced with this situation, the Prosecutor's Office requested, as a precautionary measure until the trial on Tuesday, a protection order, a request that the Court denied.

And it is that according to the Court "with the data available so far it is not appreciated that there is an objective situation of risk" for her and that "since the events occurred (four days ago) the couple has continued to live together."

It also took into account that the person investigated has no criminal record and that the woman has not filed a complaint against her husband. It is more of her, in her statement as injured by her, she asked that they not separate her from her husband and that they not separate her 2-year-old son from her father.

Two requirements are required for the protection order: that there be indications of the commission of a crime, which is appreciated in this case, and that there is an objective situation of risk, something that the judge does not see.
