Upamecano remains blocked: FC Bayern is dismissed in court with an objection

The requirements for getting away without a suspension despite a red card are high - and in the case of Dayot Upamecano not fulfilled. The DFB sports court therefore rejects the appeal of the Bayern defender. The French defender has to watch the Bundesliga top game against 1. FC Union.

The one-game ban after the red card against Dayot Upamecano from Bayern Munich remains in place. The sports court of the German Football Association (DFB) confirmed the ban for unsportsmanlike conduct against the French defender in a written procedure. The panel rejected an objection by the national player and thus followed the single judge's decision on Tuesday. This means that the German record champions will have to do without the 24-year-old in the top Bundesliga game against 1. FC Union Berlin on Sunday (5.30 p.m. / DAZN and in the live ticker on ntv.de).

"The referee has made a factual decision. These are protected by FIFA in the interests of a functioning game operation worldwide. The only exception to this would be an obvious error on the part of the referee. This occurs in the case of a mistaken player, or if there is demonstrably no difference between the player and his opponent contact was made," said the chairman of the DFB sports court, Stephan Oberholz. "Neither is the case here. Irrespective of that, based on the television pictures and the descriptions given by the referee, the existence of an error is doubtful."

Upamecano was sent off last Saturday in the 8th minute by referee Tobias Welz after an emergency brake on Alassane Plea. Coach Julian Nagelsmann had complained massively about the dismissal and had become abusive to the referee team in the dressing room. In a ZDF interview, he admitted that when he broke out, the expression "softened pack" was also made.

Nagelsmann was fined 50,000 euros for this on Wednesday, the 35-year-old had waived an objection and agreed to the penalty. "Since he had not yet appeared before the sports court, apologized that same evening and also showed insight in the statement to the control committee, the committee refrained from applying for an indoor ban," it said in the corresponding message.
