Deggendorf (dpa / lby) - In the Deggendorf retrial for the violent death of a young woman from the Bavarian Forest in 2016, the defenders have filed a bias application. It said her client had gained the impression that the judges were not impartial.

The defense lawyers justified this on Thursday before the Deggendorf district court, among other things, with the fact that their request to hear two more new witnesses had recently been rejected by the judges - after the judges had initially tried to allow the witnesses to testify on the same day reach.

The application was therefore only rejected because it was not possible to hear the witnesses immediately. This gave her client the impression that it was not about finding the truth, but about bringing the proceedings to an end as quickly as possible. The defense attorneys asked for a statement from the judges, which they later received in writing.

The public prosecutor said that the application for bias was "unfounded" and that the accusation of arbitrariness was "bottomless". The Chamber is trying to work through the case meticulously.

The 28-year-old is accused of murdering his ex-girlfriend. In a first trial before the Passau Regional Court in 2017, he was finally sentenced to twelve years in prison for manslaughter. Because in the first trial two witnesses had testified falsely in favor of the accused - for which they were legally sentenced to suspended sentences in 2019 before the Passau District Court - the case was reopened in May of this year in a retrial.

A decision on the bias petition is expected to be announced on the next day of the hearing, September 19.
